1. Agreement

These Terms govern your use of buildingdigitalempire.store (the "Site") and any purchase from BUILDING DIGITAL EMPIRE LLC ("we", "us"), a limited liability company registered in New Mexico, USA, at 1209 Mountain Road Pl NE, Ste 10376, Albuquerque, NM 87110.

By browsing the Site or placing an order, you agree to these Terms. If you don't agree with them, please don't use the Site. Our Privacy Policy, Shipping Policy and Returns Policy are incorporated into these Terms by reference.

2. Eligibility

You must be at least 18, or the age of majority where you live, to place an order. By ordering you confirm the information you give us is accurate and that you're authorised to use the payment method.

3. Products & handmade variation

Everything we sell is handmade. Your item will differ from the photograph in grain, glaze, texture, hammer marks, dye saturation and exact dimensions. These are characteristics of handmade work, not defects, and they're not grounds for a faulty-item claim.

Product images illustrate the style and are not exact representations of the specific piece you receive. Colours also vary between screens.

Where a product is made by a partner co-op or printed outside the United States, we say so on that product page. We describe our materials and methods accurately and we don't claim any product is something it isn't.

Stated dimensions and weights are nominal, with a reasonable tolerance for handmade work — generally within 10%.

4. Pricing & availability

• Prices are in US dollars (USD) and exclude tax unless stated.
• Sales tax is calculated at checkout based on your delivery address.
• We may change prices at any time, but never after you've placed an order.
• Stock counts are indicative. Items may sell out between adding to cart and checkout.

Pricing errors. If a product is listed at an obviously incorrect price through human or technical error, we may cancel the order and refund you in full, even after confirmation. We'll tell you before we do, and you'll never be charged more than the price shown at checkout.

5. Orders & acceptance

Your order is an offer to buy. Our confirmation email acknowledges receipt but does not accept the offer — the contract forms when we dispatch the item. We may decline an order where:

• The item is unavailable or the maker can't fulfil it
• There was a pricing or description error
• We suspect fraud or a payment problem
• We can't ship to your address

If we decline after payment, you get a full refund. That's the whole remedy.

Changes and cancellations. Contact us within 12 hours of ordering and we'll almost always catch it before production. After dispatch, our Returns Policy applies.

6. Payment

• We accept major credit and debit cards, PayPal, Apple Pay and Google Pay.
• Payment is taken when you confirm your order.
• Card details are processed by a PCI-DSS compliant third-party processor. We never see or store your full card number.
• You warrant that you're authorised to use the payment method you provide.

7. Bulk & wholesale terms

Orders of 10+ units of a single product qualify for tiered pricing:

Additional terms for bulk orders:

• Estimates aren't quotes. Figures shown by the bulk builder on this Site are indicative. Only a written quote from us is binding.
• Deposit. Orders over $500 generally require 50% up front to begin production, with the balance due before dispatch.
• Lead times. Typically 2–4 weeks, or 5–6 weeks above 250 units. Confirmed in writing before payment.
• Custom runs start at 25 units and require written sign-off on a sample or spec before production. Once approved, custom work isn't cancellable.
• Cancellation. Full refund before production starts. After that, the deposit covers committed materials and labour and isn't refundable.
• Tolerance. For runs over 100 units we may deliver within ±2% of the quantity ordered, billed at the delivered quantity.
• Private label. You warrant you own the rights to any logo or artwork you supply, and you indemnify us against third-party claims arising from its use.

WhatsApp messages composed by this Site are enquiries, not binding orders. Nothing is charged until you approve a written quote. See the bulk page.

8. Shipping & risk

Delivery estimates are estimates, not guarantees, and don't include the make time stated on each product page. Title and risk of loss pass to you on delivery to your address. For international orders, you are the importer of record and responsible for all duties and import taxes. Full details are in our Shipping Policy.

9. Returns

30 days from delivery, unused and in original packaging. Personalised and custom items are excluded unless faulty. Full details, including who pays return postage, are in our Returns & Refunds Policy. Nothing in these Terms limits your statutory rights.

10. Acceptable use

You agree not to:

• Use the Site unlawfully or fraudulently
• Scrape, crawl or harvest content or data except for ordinary search-engine indexing
• Attempt to gain unauthorised access to any part of the Site or its systems
• Introduce malware, or interfere with the Site's operation
• Resell our products as your own without a written wholesale or private-label agreement
• Place orders using someone else's payment method without their authorisation

11. Intellectual property

All content on this Site — text, product photography, illustrations, logos, layout and code — is owned by BUILDING DIGITAL EMPIRE LLC or our makers and is protected by copyright and trademark law.

You may view and print pages for your own personal, non-commercial use. You may not reproduce, republish or use our content commercially without our written permission. Our makers retain the rights to their own designs.

Buying a product gives you ownership of that physical object. It doesn't transfer any design rights, and it doesn't give you the right to reproduce the design.

12. Disclaimers & liability

The Site is provided "as is". We don't warrant that it will be uninterrupted or error-free. We warrant that products will match their description and be free from material defects in workmanship — subject to the handmade variation described in section 3.

To the maximum extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We're not liable for indirect, incidental or consequential losses, including lost profits or lost business.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that can't lawfully be excluded. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

Product safety. Follow the care instructions on each product page. Never leave a burning candle unattended, near anything flammable, or within reach of children or pets. Wooden items are hand-wash only — dishwashing them will crack them and isn't covered.

Force majeure. We're not liable for delays caused by events outside our reasonable control, including natural disasters, carrier failures, customs delays, supply shortages or public health emergencies.

13. Governing law & disputes

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law rules. The courts of Bernalillo County, New Mexico have exclusive jurisdiction, except that consumers may bring proceedings in their own country of residence where local law gives them that right.

Please talk to us first. Almost every dispute we've had was solved by a message. Contact us before starting formal proceedings and we'll make a genuine effort to resolve it within 30 days.

Severability. If any provision is found unenforceable, the rest stays in force.
